4. User Accounts & Responsibilities

• Not share, transfer, or sell your account credentials

Platform Harm

• Engaging in competitive intelligence gathering through deceptive means
• Reselling, redistributing, or commercially exploiting our Service without permission
• Creating derivative works or competing products using our technology
• Impersonating CleverGraph, its employees, or other users

6. Credits, Billing & Payments

CleverGraph operates on a credit-based billing system:

• Credits are consumed when you use AI-powered features
• Pricing is transparent and displayed before each action
• Payments are processed securely through Stripe and PayPal
• We do not store your payment card details on our servers
• Purchased credits do not expire; promotional credits may have expiration dates
• Refunds are handled on a case-by-case basis — contact support for assistance
• We reserve the right to modify pricing with 30 days advance notice

7. Intellectual Property

Your Content

You retain full ownership of all data, research, visualizations, and content you create or upload to CleverGraph. We claim no ownership rights over your work. By using our Service, you grant us only the limited license necessary to provide the Service to you (e.g., storing and displaying your content).

Our Content

All CleverGraph branding, technology, features, designs, and documentation are owned by BESTOFMINE and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Disclaimers & Limitation of Liability

Research results and data visualizations are for informational purposes only and should not be construed as professional advice (financial, legal, medical, or otherwise). Always consult qualified professionals before making important decisions based on any information.

Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss of profits, data, goodwill, or business opportunities
• We are not responsible for third-party content, links, or services
• Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater
• We are not liable for any decisions made based on information provided by our Service

9. Indemnification

You agree to indemnify, defend, and hold harmless BESTOFMINE, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service; (c) your User Content; (d) your violation of any third-party rights; or (e) any claim that your actions caused damage to a third party.

10. Platform Protection & Integrity

You specifically agree NOT to:

• Make false, misleading, or defamatory statements about CleverGraph or its services
• Publish fraudulent reviews, testimonials, or feedback
• Engage in coordinated inauthentic behavior to harm our reputation
• Disclose security vulnerabilities publicly without responsible disclosure
• Interfere with our business relationships or partnerships
• Misrepresent your affiliation with CleverGraph

We reserve the right to pursue all available legal remedies against parties who harm our platform, including but not limited to injunctive relief, damages, and recovery of legal fees.

11. Security & Responsible Disclosure

We take security seriously and implement industry-standard protections. If you discover a security vulnerability, we ask that you:

• Report it to security@bestofmine.com promptly
• Allow us reasonable time to investigate and remediate before public disclosure
• Refrain from accessing or modifying data belonging to other users
• Act in good faith to avoid privacy violations and service disruption

We commit to working with security researchers in good faith and will not pursue legal action against those who responsibly disclose vulnerabilities.

12. Termination

By You: You may terminate your account at any time through account settings or by contacting support. Upon termination, you may request deletion of all your data.

By Us: We may suspend or terminate your account if you violate these Terms, engage in prohibited activities, or if required by law. We will provide notice where reasonably practicable. Upon termination, your right to use the Service ceases immediately.

Provisions that by their nature should survive termination shall remain in effect, including but not limited to intellectual property rights, disclaimers, limitation of liability, and indemnification.

13. Dispute Resolution

We believe in fair and efficient dispute resolution:

• Mediation: If informal resolution fails, parties agree to attempt mediation before litigation.
• Governing Law: These Terms are governed by the laws of the jurisdiction where BESTOFMINE is incorporated.
• Venue: Any legal proceedings shall be brought in courts of competent jurisdiction.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CleverGraph.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
• Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our consent.
• Modifications: We may update these Terms with 30 days notice. Continued use constitutes acceptance.
• Force Majeure: We are not liable for delays caused by circumstances beyond our reasonable control.
